How Insolvency Practitioners Work
When you initially approach an Insolvency Practitioner, their job is to advise you as a director and as such the advice given will focus on your view of the Company’s financial position and your future objectives for the business. You will also be advised on your responsibilities as a director and on your duties in the period between receiving initial advice and entering into any formal insolvency process.
Once an Insolvency Practitioner informally appointed in an insolvency process, be it as liquidator, administrator or supervisor of a voluntary arrangement, their primary duty becomes to the creditors rather than to you as director. As such, the Insolvency Practitioner must then act in the best interests of the creditors as a whole.
A good Insolvency Practitioner will make you aware of their changing duties from the outset and will ensure that the advice given to you in the initial period takes account of their responsibility to creditors to ensure that your objectives for your business can be achieved without any unpleasant surprises in the future. Because of this, it is important that you deal with and are advised by an Insolvency Practitioner from the outset rather than by an unqualified “business recovery expert”.
